2. Legal bases and purposes
Personal data is processed only where this is necessary to provide the website, respond to enquiries, perform contracts, process payments, comply with legal obligations or on the basis of valid consent.
The legal bases include, in particular, Article 6(1)(b) GDPR for contracts and pre-contractual measures, Article 6(1)(c) GDPR for legal obligations, Article 6(1)(f) GDPR for legitimate interests such as the secure operation of the website, and Article 6(1)(a) GDPR where processing is based on consent.
3. Website and server log data
When the website is accessed, the hosting provider may process technically necessary data, including IP address, date and time of access, requested address, referrer, browser type, operating system and technical error data. This serves the secure and stable operation of the website and the prevention of misuse.
The data is not combined into advertising profiles without a separate legal basis. The specific retention period depends on the technical and legal requirements applicable to the hosting provider used.
4. Cookies, tracking and external media
The current DRIVEFILM website does not use non-essential marketing or analytics cookies and does not use external tracking or video services. The showreel is hosted directly by DRIVEFILM. No external web fonts from Google or comparable providers are loaded.
If non-essential cookies, analytics tools, external media or comparable services are introduced in the future, this Privacy Policy will be updated before they are used and consent will be obtained where required.
5. Contact by email or telephone
When you contact DRIVEFILM, the information you provide is processed to handle your enquiry and, where applicable, to take pre-contractual or contractual measures. This may include your name, contact details, message or call content and information about the vehicle.
6. Orders and film production
For the ordering and performance of a DRIVEFILM contract, data may include your name, billing and contact details, information about the recipient, vehicle data, shoot location, appointment details, production arrangements and, where applicable, information about participating persons.
Photographs and video recordings may contain personal data. They are processed for the performance of the contract. Publication for reference or advertising purposes takes place only on the basis of separate voluntary permission.
7. Payment processing
DRIVEFILM uses Stripe for online checkout. When a payment is made, data required for payment processing is transmitted to Stripe. Depending on the processing activity, Stripe may act as a processor on behalf of DRIVEFILM and/or as an independent controller for its own purposes. Data may include, in particular, name, email address, billing or shipping address, payment data, purchase amount, purchase date and transaction-related information.
For customers in the European Economic Area, Stripe Payments Europe, Limited and Stripe Technology Company, Limited, both based in Ireland, may be involved in processing. Stripe may transfer data to affiliates, service providers or payment providers in other countries where this is necessary for payment processing, fraud prevention, security or other permitted purposes. Stripe describes the safeguards it uses for such processing in its Privacy Center and the privacy and transfer information linked there.
8. Recipients and processors
Depending on the function used, personal data may be transmitted to hosting, email, payment, IT, storage or shipping service providers. Where legally required, data processing agreements pursuant to Article 28 GDPR are concluded.
9. Retention periods
Personal data is deleted as soon as the purpose for processing no longer applies and there are no statutory retention obligations or legitimate reasons for longer retention.
Business and tax records are retained in accordance with statutory retention periods. In particular, invoices are currently subject to an eight-year statutory retention period under German law; longer periods may apply to certain records depending on the applicable legal requirements.
The private download link for completed films is generally available for 30 days.
10. Your rights
Subject to the statutory requirements, you have in particular the right of access, rectification, erasure, restriction of processing, data portability and objection to certain processing activities. Where processing is based on consent, you may withdraw that consent at any time with effect for the future.
To exercise your rights, please contact filmgeschenk@drivefilm.de.
11. Right to lodge a complaint
