Terms & Conditions
Language note: This English version is provided for convenience. In the event of any discrepancy, the German version shall prevail.
1. Scope
These Terms & Conditions apply to contracts for DRIVEFILM gift vouchers and the production of the individual car film based on such vouchers between Marcus C. Bohlander, Mannheimer Str. 174, 67657 Kaiserslautern, Germany, and the customer.
2. Subject of the contract
The DRIVEFILM voucher entitles the holder to the production of an individual car film about one vehicle. The standard scope includes a shoot of up to three hours on location, a main film with an exact running time of 77 seconds, professional post-production including editing, dramaturgy, licensed music and color grading, a 4K and a Full HD version, and two vertical versions in 4K (2160 × 3840) and Full HD (1080 × 1920).
The standard price includes two correction rounds within the existing production material. CGI and AI-CGI are not part of the standard scope.
The vehicle must be roadworthy and ready for the agreed recordings. Driving, movement and engine-sound recordings are part of the production concept.
3. Conclusion of contract and price
The standard gift voucher costs €2,560.00. As a small business within the meaning of Section 19 UStG, no VAT is shown. The contract is concluded through the online checkout or through an individually confirmed conclusion of contract.
For an online contract, the information required by law is provided before the order is submitted. The contract confirmation and contractual documents are provided on a durable medium, usually by email.
4. Payment
The voucher is issued against full advance payment. The payment methods offered in the checkout are displayed there.
5. Voucher and redemption
The voucher entitles the holder to use the agreed standard scope once for one vehicle. The agreed redemption period is 23 months from the date of issue. Statutory rights remain unaffected insofar as an agreed limitation period should not be legally effective in an individual case.
The voucher is provided digitally. A physical DRIVEFILM gift card may be purchased separately if offered.
No cash payment is made in exchange for the voucher unless mandatory statutory rights require otherwise.
6. Appointment, shoot location and cooperation
The shoot date is arranged directly with the recipient or the named contact person after redemption. The standard shoot takes place at the customer's location or at another mutually agreed location.
DRIVEFILM can be booked throughout Germany. In addition to the voucher price, a travel fee applies based on the one-way road distance from Kaiserslautern: up to 100 km +€99, 101–250 km +€299, 251–400 km +€499, 401–550 km +€699 and over 550 km +€899 within Germany. The applicable travel fee is communicated transparently before the appointment is confirmed. Austria and Switzerland are available on request. Chargeable locations and required filming permits are not included in the standard price and are only commissioned with prior approval.
The customer is responsible for ensuring that the rights required for recordings on property, of persons or in other protected areas can be obtained.
7. Weather and rescheduling
If the agreed production cannot reasonably or safely be carried out because of weather conditions, the appointment will be rescheduled free of charge. Safety and weather conditions take priority over carrying out a shoot.
8. Production and delivery
The finished film is delivered within 17 business days after the shoot, provided that all required production materials are available and there are no delays for which the customer is responsible.
The finished files are provided via a private download link. The download link is available for 30 days. The customer is responsible for securing the delivered files within this period.
9. Corrections
The standard price includes two correction rounds. Corrections relate to the existing production material and the agreed design. New shoot requests, additional production material or a fundamentally new concept are not correction rounds and may be quoted separately.
10. Music
Licensed music is used for the standard film. A specific song requested by the customer may only be used if the necessary usage rights exist or can be additionally licensed. Any additional licensing costs will be communicated in advance.
11. Additional services
Additional services or optional extensions are not part of the standard price and only become part of the contract if expressly ordered and confirmed in advance. The applicable prices and scope of services will be communicated transparently before the order.
12. Usage rights
After full payment, the customer or recipient receives the right to use the finished film versions privately and to publish them personally on their own social media profiles.
Commercial use, resale, licensing to third parties and transfer of raw footage are not included in the standard price and require a separate agreement.
Copyright and rights to the production materials remain with Marcus C. Bohlander unless expressly agreed otherwise.
13. Optional reference permission
DRIVEFILM will only publish the finished film for its own advertising or reference purposes on the basis of a separate voluntary permission. Reference permission is not a condition for film production.
14. Liability
DRIVEFILM is liable without limitation for damage resulting from injury to life, body or health and for damage caused by intent or gross negligence. In the event of slightly negligent breach of essential contractual obligations, liability is limited to the foreseeable damage typical for the contract. Mandatory statutory liability remains unaffected.
15. Consumer rights
Statutory warranty rights, the statutory right of withdrawal and other mandatory consumer protection rights remain unaffected. Details of the right of withdrawal are provided in the separate withdrawal information.
16. Dispute resolution
Marcus C. Bohlander is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
17. Final provisions
German law applies. For consumers, this choice of law applies only insofar as it does not deprive them of the protection afforded by mandatory provisions of the law of the country in which they have their habitual residence.
If individual provisions of these Terms & Conditions are or become invalid, the statutory provisions shall apply.
